ENVIRONMENTAL CREDITS – Unless otherwise agreed in writing by both parties, Customers of SWD’s products recognize and agree that any and all environmental credits, including but not limited to carbon offset credits, or other rights, titles, privileges, licenses, or interests with respect to the sale of any of SWD’s products, shall remain the property of SWD. Customers of SWD’s products further recognize and agree that they have not assigned any additional environmental and/or carbon offset credits or other rights, titles, privileges, licenses or interests that may otherwise arise out of the Customer’s use of SWD’s products.
